BEAVERCREEK, Ohio (WDTN) — While a late-night TV host is calling on Buc-ee’s to sue him, the Texas-based travel center has instead set its sights on yet another small business.
Buc-ee’s, which opened its first location in Ohio earlier this year, is suing Beaver’s Mini Mart in Beavercreek, Ohio, for what it alleges is trademark infringement.
In the suit, filed days ago, Buc-ee’s alleges that the Mini Mart’s cartoon beaver mascot is too similar to its own, with its “wide eyes and a smile” that also “uses red as a predominant color,” and could cause confusion.
The new Buc-ee’s location in Huber Heights, Ohio, is 16 miles from Beaver’s Mini Mart.
Beaver’s Mini Mart customers say they have been shopping there for decades, while Buc-ee’s has existed in the Buckeye State only since April.
“Reading into it more that Buc-ee’s has gone after other companies over this… It just put a bad taste in my mouth because they just seem like such a fun company,” resident Sam Bryan told Nexstar’s WDTN. “To see this, that they’re coming after a small business like this, it upset me like it did a lot of Beavercreek residents.”
The community is looking to support Beaver’s Mini Mart financially. A local Facebook group is organizing an all-day cash mob on Friday, Aug. 7, encouraging people to come in and spend $20 to support the Beavercreek business. A GoFundMe has also been set up for the mini mart.
WDTN has reached out to both Beaver’s Mini Mart and Buc-ee’s for a statement.
In February, Buc-ee’s filed suit against the Ohio-based owner of Mickey Mart over the smaller chain’s plan to change its name to Mickey’s. These gas stations, known as Mickey’s, have been using their Mickey the Moose mascot since at least 2020 — long before Buc-ee’s opened its first location in Ohio.
Last month, “Last Week Tonight” host John Oliver took aim at Buc-ee’s and its lawsuits during a segment, egging the company on to sue him. Oliver explained that Buc-ee’s had won many of the more than a dozen lawsuits it has brought against businesses, mainly over their animal-based logos.
Last year, Buc-ee’s sued a Florida store and a South Carolina apparel company over alleged copyright infringement. And a Missouri business settled while another shuttered after Buc-ee’s accused both of trademark infringement, Nexstar’s KOLR reported.
An Oklahoma underwear and apparel company also vowed to fight back against a lawsuit brought by Buc-ee’s, with owner Jarrad Hewett telling Nexstar’s KFOR in November that “it’s time that somebody stands up and says, ‘This isn’t right.’”
Oliver seemingly agreed, saying his show has “the will to get into a fight with Buc-ee’s.” To poke the beaver further, Oliver showcased merchandise featuring a cartoon version of Mr. Nutterbutter, who has appeared on his show several times, with the slogan “Buc-off” in a very Buc-ee’s style. All of the merchandise, ranging from T-shirts and hats to onesies and coffee mugs, can be found at Buc-off.com.
Proceeds from the online store, which, at least for now, is slated to be open until Sept. 8, will reportedly go to Hunger Free America. A notice on the website warns that the items are “not authorized by or affiliated with Buc-ee’s.”
“So, if any prominent gas station chain out there has an issue with our new logo and products and wants to get lawyers involved, then you know what? Bring it the f— on,” Oliver warned. “Although, remember, in doing so, you’d be directly taking food out of hungry people’s mouths.”
Buc-ee’s did not respond to Nexstar’s request for comment regarding Oliver’s antics. The host told The Hollywood Reporter on Friday that Buc-ee’s hasn’t responded to them, either.
He admitted that Buc-ee’s “aggressively told us that they would not be engaging in any questions — including things as simple as ‘How many flavors of fudge do you actually sell?’ I hear that they are going to let this go. So, we’ll see.”
