Senate Majority Leader John Thune (R-S.D.) on Tuesday said the controversy surrounding Rep. Max Miller (R-Ohio) is an issue for the House and Ohio voters to decide, as well as “a family matter.”

“It’s a very sad and unfortunate case. It is a family matter, and I just, I don’t have any observations beyond that,” Thune told reporters Tuesday when he was asked whether he agreed with Sen. Bernie Moreno (R-Ohio) that Miller should resign from Congress.

Moreno’s daughter, Emily Moreno, has leveled accusations of domestic abuse at Miller, to whom she was married until last year. The two have been engaged in a bitter custody battle over their young daughter. Sen. Bernie Moreno over the weekend called for Miller to step down.

Miller has repeatedly and vehemently denied all the allegations against him.

Pressed further, Thune said “that’s something that the House of Representatives — it’s a House matter, and obviously, as I said before, it’s a family issue, too, in this case.”

“But, I think, you know, those decisions on the future there are going to be made ultimately by the people of Ohio, and I think that’s true,” he added.

Miller, who is seeking reelection in Ohio, has faced increasing pressure to resign or drop out of the race. He has remained defiant, insisting he will remain in Congress and on the ballot.

On Tuesday, the House Ethics Committee announced it had opened a probe into Miller to review allegations of domestic violence and abuse or illegal drug use.

The announcement came quickly after Miller said he would file paperwork for the committee to investigate him because he has “nothing to hide.”

Emily Moreno has alleged that the Ohio Republican hurled scalding hot water at her, held a gun to her head and fractured their daughter’s collarbone. Miller has denied the allegations, suing Moreno for defamation in May.
