New in Whitmer Kidnapping Case: Judge Denies Defense Motion to Dismiss Case

January 25, 2022 — The latest in the USA vs Fox, et al, aka the so-called “Whitmer Kidnapping Hoax” or the “Michigan Caper,” is an Order Denying the Defense Motion to Dismiss the case based on egregious government misconduct and entrapment. Federal Judge Jonker noted in the Order that the defendants “fail to carry the burden” of showing undisputed evidence of entrapment. Thus the case will proceed towards a jury trial, commencing on March 8, 2022.

This ruling comes in response to the defense’s Motion to Dismiss the case, arguing that the government violated its own procedures and the rights of the defendants. They claim their clients were entrapped by the government amid allegations of serious misconduct on the part of the FBI handling agents and informants, some of whom the government will not be calling to testify at trial. The Department of Justice claims the defendants had a “predisposition” and were not entrapped.

This Order Denying the Motion to Dismiss does not claim that there was NO entrapment, importantly; it simply states that the evidentiary threshold required to dismiss the case outright was a very high burden and that the judge felt it was best for a jury to make that determination.
